General Data Protection Provisions
Dear Customers and Website Visitors,
The web services we provide (http://www.eltec.de) are classified as telecommunications media services. As a telecommunications media service provider pursuant to Art. 13 par. 1 TMG (Telemediengesetz ≈ German Telecommunications Media Act) we are required to brief website visitors on the type, scope and purpose of the personal data we collect and utilize at the beginning of the site visit.
In conjunction with this Data Protection Declaration we would like to inform you that we warrant the protection of the data you share with us. We collect, process or use personal data of our existing and potential customers within the scope of the applicable statutory provisions.
The processing and archiving of data is necessary in order for us to be able to establish and administrate business relationships with our customers. We utilize this data to the extent necessary for us to protect our rights and meet our obligations arising from the business relationship pursuant to Art. 28 par. 1 BDSG (Bundesdatenschutzgesetz ≈ German Federal Data Protection Act). We do not use your data for the purpose of advertising or market research or for the creation of user profiles.
We do have a vested interest in protecting your personal data.
We have implemented comprehensive technical and operational security precautions to protect the personal data we have on hand from you against any and all unauthorized access and misuse. Our security procedures are subjected to audits at regular intervals and are updated to remain on par with the technological progress made. Our employees are required to enter into data protection covenants and are required to keep your data confidential.
We do not collect any sensitive (i.e. special types of) personal data as defined in Art. 3 par. 9 BDSG.
Notification of Affected Parties
Whenever personal data is stored by us for our own purposes in the absence of the affected parties’ knowledge the first time, the affected parties will be notified of the storage, type of storage, type of data, the intended purposes of collecting, processing or using such data and of the identity of the responsible authority/department.
Recording, Storing and Processing of Personal Data
Personal data, such as the name, address, telephone number or e-mail address shall not be recorded unless such information has been provided by you on a voluntary basis, e.g. in conjunction with an online inquiry. Personal data collected during a visit to our website shall be processed exclusively in compliance with the applicable data protection provisions.
We would like to advise you that by transmitting data via the Internet, e.g. via web entry forms, we are subject to the provisions of the German Telecommunications Media Act (TMG = Telemediengesetz) and with regard to e-mails to the German Telecommunications Law (TKG = Telekommunikationsgesetz). Secure transmissions cannot be warranted if communications are sent via e-mail.
Every time a user accesses a page of our website or a file, data pertaining to this process is stored in a log file.
The data generated is not personal data, i.e. we are not in a position to trace which user accessed which data. Specifically, the following data batches are stored for each access transaction:
- Name of the accessed file
- Date and time of access
- Volume of data transferred
- Notification as to whether the access transaction was successful
The IP address of the computer the inquiry was sent from will not be archived. Hence, it is not possible to create personalized user profiles.
Transparency is very important to us. Upon your written request, we will be pleased to confirm to you – within the scope of our statutory obligations – whether any of your personal data and if so, which of your personal data has been archived by us. Subject to compliance with the conditions set forth in the provisions of the German Federal Data Protection Act BDSG you may have the right to demand the correction, blockage and deletion of said data unless minimum statutory archiving provisions require us to do otherwise.
